1. Acceptance of These Terms

Welcome to Casa de Queta LLC ("Casa de Queta," "we," "our," or "us").

These Website Terms of Use and Conditions of Sale ("Terms") govern your access to and use of the Casa de Queta website (the "Website"), together with any purchases made through the Website.

By accessing or using the Website, creating an account (if available), or purchasing Products from us, you agree to be legally bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Refund Policy, each of which is incorporated into these Terms by reference.

If you do not agree to these Terms, you should not access or use the Website.

2. Eligibility

You represent and warrant that:

(a) you are at least eighteen (18) years of age or the age of majority in your jurisdiction;

(b) you have the legal capacity to enter into this agreement; and

(c) you will use the Website only in accordance with these Terms and all applicable laws.

By using the Website or communicating with us electronically, including by email or through forms available on the Website, you consent to receive communications from Casa de Queta electronically. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

3. Products

Casa de Queta sells handmade home goods, gifts, candles, and other cultural products (collectively, the "Products").

We make every reasonable effort to display our Products accurately. However, because of differences in monitors, lighting, photography, and natural materials, the Products you receive may vary slightly from the images displayed on the Website.

Such variations do not constitute defects.

We reserve the right to modify, discontinue, or limit the availability of any Product without prior notice.

4. Handmade Products

Many Casa de Queta Products are handcrafted or produced in small batches.

Accordingly, slight variations in color, wood grain, ceramic glaze, texture, finish, fragrance, dimensions, packaging, or appearance should be expected and are part of the unique character of handmade products.

These variations are not considered manufacturing defects.

5. Candle Safety

Certain Products sold by Casa de Queta contain an open flame and must be used responsibly.

By purchasing a candle, you acknowledge and agree that you are responsible for its safe use.

Without limitation, customers should:

(a) never leave a burning candle unattended;

(b) keep candles away from children and pets;

(c) burn candles only on stable, heat-resistant surfaces;

(d) keep candles away from curtains, paper, decorations, and other combustible materials;

(e) trim the wick before each use; and

(f) discontinue burning when approximately one-half inch of wax remains.

Failure to follow proper candle safety practices may result in fire, personal injury, or property damage.

To the fullest extent permitted by applicable law, Casa de Queta LLC shall not be responsible for damages arising from misuse of any candle or failure to follow applicable safety instructions.

6. Orders

Submission of an order constitutes an offer to purchase Products from Casa de Queta.

Acceptance of an order occurs only after the Product has been shipped or we have otherwise confirmed acceptance.

We reserve the right, in our sole discretion and to the extent permitted by law, to refuse, cancel, or limit any order for reasons including, but not limited to:

(a) Product availability;

(b) pricing or inventory errors;

(c) suspected fraud;

(d) payment authorization issues; or

(e) suspected unauthorized resale.

If payment has already been collected for a canceled order, we will issue an appropriate refund.

7. Pricing

All prices are listed in U.S. Dollars unless otherwise indicated.

Prices are subject to change without prior notice.

Although we strive for accuracy, pricing or description errors may occasionally occur. We reserve the right to correct such errors and cancel affected orders before shipment. If payment has already been received, an appropriate refund will be issued.

8. Shipping

Shipping times provided on the Website are estimates only.

Delivery dates are not guaranteed.

Casa de Queta is not responsible for shipping delays resulting from weather, carrier delays, customs processing, inaccurate shipping information provided by the customer, or other circumstances beyond our reasonable control.

9. Returns and Refunds

Returns, exchanges, and refunds are governed exclusively by our Refund Policy.

By placing an order, you acknowledge that you have reviewed and agree to that policy.

10. Intellectual Property

All content appearing on the Website—including, without limitation, our trademarks, logos, product names, photographs, artwork, graphics, text, designs, videos, product descriptions, software, and overall Website design—is owned by or licensed to Casa de Queta LLC and is protected by United States intellectual property laws.

Except as expressly permitted by these Terms, no portion of the Website or its content may be copied, reproduced, modified, distributed, displayed, published, transmitted, sold, licensed, reverse engineered, or otherwise exploited without the prior written consent of Casa de Queta LLC.

11. User Reviews and Submissions

If you submit reviews, comments, photographs, or other content to Casa de Queta, you grant Casa de Queta LLC a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, publish, modify, display, and distribute such content for business and marketing purposes.

You represent and warrant that:

(a) you own or otherwise control all rights to the content you submit;

(b) your submission is accurate;

(c) your submission does not violate these Terms or any applicable law; and

(d) your submission does not infringe upon the rights of any third party.

12. Prohibited Uses

You agree not to:

violate any applicable law;

interfere with the operation or security of the Website;

upload malicious software or harmful code;

impersonate another person or entity;

scrape, harvest, or copy Website content without permission;

misuse our intellectual property;

attempt unauthorized access to our systems or networks.

Violation of this section may result in immediate termination of your access to the Website and any other remedies available under applicable law.

Nothing in these Terms limits or excludes any consumer rights or warranties that cannot legally be waived under applicable law.

To the fullest extent permitted by applicable law, Casa de Queta LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Website or any Product.

Our aggregate liability for any claim relating to a Product shall not exceed the purchase price actually paid for that Product.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

17. Indemnification

You agree to indemnify, defend, and hold harmless Casa de Queta LLC, its owners, officers, employees, contractors, and affiliates from and against any claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising out of your violation of these Terms or your misuse of the Website.

18. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms, the Website, or any purchase made through the Website shall be brought exclusively in the state or federal courts located in Harris County, Texas, and each party irrevocably consents to the jurisdiction and venue of those courts.

19. Force Majeure

Casa de Queta LLC shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from causes beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, flood, pandemic, epidemic, labor disputes, supply chain disruptions, transportation delays, governmental actions, war, terrorism, civil unrest, utility outages, internet or telecommunications failures, or other events beyond our reasonable control.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Casa de Queta LLC regarding your use of the Website and purchase of Products and supersede any prior understandings relating to the same subject matter.

22. Changes to These Terms

We may revise these Terms from time to time in our sole discretion.

Changes become effective immediately upon posting the revised Terms on the Website unless otherwise required by applicable law.

Your continued use of the Website following any update constitutes your acceptance of the revised Terms.
